Terms of Business

1) Our Service

According to your instructions, we will perform the following services on an ad hoc basis:

A) Certification and/or legalisation by notary
B) Certification and/or legalisation by solicitor

If it is necessary to carry out work outside the responsibilities outlined in this letter we will advise you in advance. This will involve additional fees.

2) Level of Service

We shall provide the above services with due speed and efficiency in accordance with your instructions. All instructions or request for services must be clearly set out in writing and addressed correctly to ourselves.

3) Hours of Business

Our practice’s normal opening hours are 9:00-17.30 from Monday to Friday.
We can be contacted by telephone, fax, e-mail and post.

4) Fees and Supplements

The level of fees is based upon the prevailing scale of charges with additional charges for items such as courier costs, embassy consulate fees, translations’ costs etc. Current scale charges list is available upon request.

Where priority services are required there will incur a fee premium.

The level of fees may be adjusted by virtue of increased third parties third party costs which are beyond our control.

Where applicable or required, Value Added Tax will be charged in addition.

5) Payment terms

Payment of our invoices is due within 30 days from date of the invoice.
Should all or part of an invoice remain unpaid, the firm reserves the right to charge interest at the interest rate from time to time published by the Law Society.

6) Data protection

We use the information you provide primarily for the provision of legal services to you and for related purposes including: updating and enhancing client records, analysis to help us manage our practice, statutory returns, legal and regulatory compliance.

Our use of that information is subject to your instructions, the Data Protection Act 1998 and our duty of confidentiality.

Please note that our work for you may require us to give information to third parties such as professional advisers. You have a right of access under data protection legislation to the personal data that we hold about you.

We may from time to time send you information which we think might be of interest to you. If you do not wish to receive that information please notify our office in writing.

7) Equality and Diversity

8) Prevention of Money Laundering

To enable us to ensure that we comply with the Proceeds of Crime Act 2002 and the Money Laundering Regulations 2007 you acknowledge and agree that:

Your failure to do so will entitle us to terminate our retainer and cease acting for you forthwith.

If, in the course of acting for you, we discover or suspect, or have reasonable grounds for knowing or suspecting that any person is engaged in money laundering we may, and in some cases will be required to, disclose this information to the to the Serious Organised Crime Agency. Depending upon the particular circumstances of the case, we may not be able to tell you that such a disclosure has been made or the reasons for it.

9) Termination of the Retainer

We reserve the right to suspend the provision of our services where our invoices are deemed by us materially overdue and we shall not consider ourselves liable for any losses, cost or penalties arising from the suspension of our services.

10) Liability

We cannot be held responsible for any delays or losses due to circumstances which are beyond our control.

We shall not have any liability to you or the Clients for any loss, damages, costs or expenses which you or the Clients suffer or incur arising from the provision of services unless such loss arises from our gross negligence.

Our liability, if any, to you or the Clients, arising from or in connection with our provision of services shall be in any event limited to the aggregate amount of fees paid to us which are referable to the matter to which the claim relates.

11) Electronic communication

Electronic Communication (e-mail) can be used between our firm and its clients and others but please note that because of the nature of e-mail, we can not guarantee its confidentiality. If you use e-mail to contact us or if you inform us of your e-mail address we will assume that you accept this risk and you impliedly allow us to communicate to you by e-mail unless you expressly instruct us not to do so.

12) Complaints

Notable Services LLP is committed to high quality legal service and client care.
If you are unhappy about any aspect of the service you have received, or about the bill, please contact us without delay.

If you are not satisfied with our handling of your complaint you can ask the Office for Legal Complaints / Legal Complaints Service at 0845 608 6565 or at www.legalcomplaints.org.uk to consider your complaint.

All solicitors must attempt to resolve problems that may arise with their services.
It is therefore important that you immediately raise any concerns you may have with this.

13) Law and Jurisdiction

The terms of our appointment (including these Terms of Business) are governed by and construed in accordance with English law. You and we hereby irrevocably submit to the non-exclusive jurisdiction of the English courts in respect of any claim, dispute or difference of whatever nature concerning our appointment and arising from it.
